DENR tagumpay sa kaso laban sa illegal cave resources trader

Muli na namang nagtagumpay ang Department of Environment and Natural Resources (DENR) sa kasong isinampa nito laban sa lalaking nahuling nagbebenta ng kinuha nitong stalactites at stalagmites noong 2016.

Sa naging desisyon ng Cavite court, napatunayang nagkasala si Joselito Laygan dahil sa pagkuha at pagbebenta ng cave resources nang walang pahintulot sa DENR. Pinagmumulta rin ito ng halagang P300,000.

Ang pangyayaring ito ay isang linggo lamang matapos iulat ng DENR ang pagkakahatol sa wildlife trader na nasa likod ng illegal shipment ng mahigit sa 700 piraso ng buhay na tarantula na naaresto sa Ninoy Aquino International Airport noong 2019.

Ayon kay DENR Secretary Roy A. Cimatu, ang dalawang magkasunod na tagumpay na ito ay nagpapatunay lamang na seryoso ang ahensiya na mahuli ang mga wildlife traders at maparusahan ang mga ito dahil sa paglabag sa batas ng tao at kalikasan.

“This decision comes at an opportune time when culprits are taking advantage of the challenges in travel and mobility of our environmental law enforcers,” sabi ni Cimatu.

“We want to show these environmental criminals how stringent the law is even in the middle of this crisis,” dagdag pa ng kalihim.

Base sa limang pahinang desisyon na inilabas ni Judge Mary Rocelyn Lim-Guillano noong Disyembre 10, napatunayan ng Bacoor City Municipal Trial Court na si Laygan ay nagkasala sa paglabag sa Section 7 nf Republic Act 9072 o ang National Caves and Cave Resources Management and Protection Act.

Nakasaad pa sa probisyon na: “gathering, collecting, possessing, consuming, selling, bartering or exchanging or offering for sale without authority for any cave resource is prohibited.”

Si Laygan ay naaresto dahil sa pagbebenta ng cave resources nang walang kaukulang permiso sa isinagawang entrapment operation ng Philippine Operations Group on Ivory and Illegal Wildlife o Task Force POGI noong Pebrero 2016.

Ang Task Force POGI ay binubuo ng wildlife enforcers mula sa iba’t-ibang ahensiya ng gobyerno kabilang ang Biodiversity Management Bureau, National Bureau of Investigation at Philippine National Police.

Magmumulta din si Laygan ng halagang Php300,000 na may six percent interest mula sa petsa mula nang ilabas ang desisyon hanggang sa tuluyan itong mabayaran ng buo.

Bukod dito, inatasan din ang Provincial Environment and Natural Resources Office sa Cavite na makipag-ugnayan sa korte para sa turnover ng cave resources sa DENR Secretary para sa wastong disposisyon.

Noong isang linggo ay inanunsiyo ng DENR na ang Pasay City Metropolitan Trial Court Branch 48 ay hinatulan si Jesse Camaro dahil sa pagbibiyahe ng 757 piraso ng tarantula na tinatayang may halagang P310,990 at may customs duties at taxes na aabot sa P54,752.

Si Camaro ay napatunayang nagkasala sa paglabag sa RA 9147 o ang Wildlife Conservation and Protection Act at nahatulang makulong ng anim na buwan at multang P20,000. Magbabayad din ito ng halagang P100,000 dahil sa paglabag sa RA 10863 o Customs Modernization and Tariff Act. ### (Strategic Communication and Initiatives Service (SCIS), Department of Environment and Natural Resources)
