EDGAR VILLANUEVA PINAWALANG-SALA SA MGA KASONG GRAFT

PINAWALANG-SALA ng Kataas-taasang Hukuman si Ingat-Yaman ng Lungsod Quezon Edgar Villanueva sa anumang kriminal na pananagutan sa pag-auction ng 3-ektaryang lupa sa sa loob ng narematang Manila Seedling Bank compound noong 2011.

Ang Manila Seedling Bank Foundation Inc. ay dating matatagpuan sa kanto ng Quezon Avenue at Epifanio delos Santos Avenue.

Ang desisyon ng mataas na hukuman ay nagpawalang-bisa sa desisyon ng Sandiganbayan na may petsang Nobyembre 2019 at Pebrero 2020 na naghatol kay Villanueva ng anim hanggang sampung taong pagkakakulong kasama ang permanenteng diskwalipikasyon na humawak sa pwesto dahil sa paglabag sa anti-graft law.

Sinabi ng Korte Suprema na walang masamang pananampalataya ang maaaring maiugnay kay Villanueva, sa halip ginampanan lamang ang kanyang tungkulin na mangolekta ng buwis sa real property batay sa mga opisyal na rekord.

“WHEREFORE, the Decision promulgated on 15 November 2019
and Resolution dated 13 February 2020 by the Sandiganbayan in Criminal Case No. SB- 17-CRM-0119 are REVERSED and SET ASIDE. Accused-appellant -EDGAR T. VILLANUEVA is ACQUITTED of violation of Section 3(e) of Republic Act No. 3019, on the ground that his guilt was not established beyond reasonable doubt,” saad sa desisyon.

Absent the decisive element of evident bad faith in charges for violation of Section 3 ( e) of Republic Act No. (RA) 3019, the prosecution cannot pass the test of moral certainty required to uphold a conviction, and the constitutionally afforded presumption of innocence of the accused must prevail.” nakasaad pa rin sa desisyon.

Sinabi ni Villanueva na bago pa man ang desisyon ng mataas na hukuman, nanalo na siya sa kasong administratibong isinampa laban sa kanya sa Court of Appeals na nag-utos sa pamahalaang lungsod na bayaran siya ng P4 milyon bilang back wages. Siya rin ay muling kinuha bilang City Treasurer noong 2019.#
